General provisions
These Terms and Conditions apply to purchases made from the online shop at www.dres.cz. All contact information can be found in the "Contacts" section. All contractual relationships are concluded in accordance with the legal system of the Czech Republic. If the contracting party is a consumer, relations not regulated by the Terms and Conditions are governed by the Civil Code (No. 40/1964 Coll.) and the Consumer Protection Act (No. 634/1992 Coll.). If the contracting party is an entrepreneur, relations not regulated by the Terms and Conditions are governed by the Commercial Code, No. 513/1991 Coll., all as amended.
Definition of terms
Consumer contract – a purchase contract, a contract for work, or other contracts according to the Civil Code, if the contracting parties are, on the one hand, a consumer and, on the other hand, a supplier or seller.
The seller (supplier) – is a person who, when concluding and performing the contract, acts within the scope of his/her commercial or other business activity. It is an entrepreneur that, directly or through other entrepreneurs, supplies products or provides services to the buyer.
The consumer (buyer) – is a person who, when concluding and performing the contract, does not act within the scope of his/her commercial or other business activity. It is a natural or legal person who purchases products or uses services for a purpose other than for doing business with these products or services.
The buyer that is not a consumer – is a person who, when concluding and performing the contract, acts within the scope of his/her commercial or other business activity.
Conclusion of the purchase contract – the buyer's order is a draft purchase contract and the purchase contract itself is concluded upon the delivery of the buyer's binding consent to this draft (binding confirmation of the order by the seller). From that moment on, mutual rights and obligations arise between the buyer and the seller, which are defined by the purchase contract and the Terms and Conditions, which are an integral part of this contract.
Terms and Conditions – the contractual arrangement between the seller and the buyer in this document. The buyer agrees to these Terms and Conditions valid and effective at the time of sending his/her/its order and is bound by them from the moment of conclusion of the purchase contract. The buyer has the opportunity to familiarize himself/herself/itself with these Terms and Conditions before placing his/her/its order and is sufficiently notified of them in advance. By sending his/her/its order, the buyer confirms that he/she/it has familiarized himself/herself/itself with these Terms and Conditions and that he/she/it agrees with them.
Withdrawal from a contract concluded by means of distance communication
If the buyer is a consumer, he/she/it may withdraw from the contract and return the goods within 14 days in accordance with Section 53(7) of the Civil Code without giving a reason. The seller will refund you for the returned goods within 30 days of receipt of the withdrawal from the contract. The prerequisite is the delivery of the returned goods. The supplier reserves the right to the reimbursement of the costs actually incurred in returning the goods (transport charges and method of payment). We will send the amount for the returned goods to your account. If you are requesting an exchange or refund, please send the product back to us without any signs of use, undamaged and preferably in the original packaging.
When sending back, please choose suitable packaging to prevent damage to the goods during transport. We also recommend that you insure the returned goods.
The buyer is liable for damage caused during transport due to the choice of unsuitable packaging. In such a case, the seller will refund the consumer the purchase price less the compensation for damage.
According to Section 53(8) of the Civil Code, the buyer cannot withdraw from a purchase contract for the supply of goods or services, the price of which depends on fluctuations in the financial market independently of the supplier's will, for the supply of goods customized according to the consumer's wishes or for his/her/its person, as well as goods that are subject to rapid deterioration, wear and tear or obsolescence.

Conflict with the purchase contract
In the event that the item is not in accordance with the purchase contract upon receipt by the buyer (hereinafter referred to as the "Non-Conformity with the Purchase Contract"), the buyer has the right to have the seller bring the item into a condition consistent with the purchase contract free of charge and without undue delay, either by replacing the item or repairing it, as requested by the buyer; if such a procedure is not possible, the buyer may request a reasonable discount on the price of the item or withdraw from the contract. This does not apply if the buyer knew about the Non-Conformity with the Purchase Contract before receipt of the item or caused the Non-Conformity with the Purchase Contract himself/herself/itself. Non-Conformity with the Purchase Contract that becomes apparent within six months of the date of receipt of the item is considered a non-conformity that already existed at the time of receipt, unless this is contrary to the nature of the item or unless the contrary is proven.
Warranty and claims
All products are covered by a warranty period of 24 months from the date of receipt of the goods for consumers and 6 months for buyers that are not consumers (entrepreneurs). If a defect in the product appears during the warranty period, please send the product (the buyer can only claim by sending the goods for complaint by a transport service, post, etc.), along with a description of the defect and your requested method of resolving the claim. Otherwise, the claim will be dealt with in accordance with the law.
The buyer is obliged to inspect the delivered goods and inform the seller without undue delay of any defects found. Later claims of obvious defects will not be accepted by the seller. Your claim will be handled within 30 days from the date of its submission. You will be informed by e-mail or phone about the settlement of your claim. The warranty does not apply to goods for which the warranty period has expired on the date of submission of the claim. Furthermore, the warranty does not apply to wear and tear of an item caused by its normal use (e.g. change in material proportional to the length of use) and to defects caused by improper maintenance and use of the product. All shipped products undergo a careful inspection.
In the event of a legitimate claim, the customer is entitled to the reimbursement of the postage costs in the necessary amount. In the event of an unjustified claim, the customer's right to any compensation for the costs associated with the handling of the claim will cease.
Rights arising from the statutory guarantee
The warranty period is extended by the period of time for which the goods were under a warranty repair. In case of replacement of the goods, the consumer receives a new warranty of 24 months.
Depending on the nature of the defect, the consumer has the following rights when exercising the warranty:
- If it is a removable defect, the right to free, proper and timely removal of the defect, the right to the replacement of the defective goods or defective parts, unless this is disproportionate given the nature of the defect, and if such a procedure is not possible, the right to a reasonable discount on the purchase price or to withdraw from the purchase contract
- If the defect is irremovable and prevents the proper use of the goods, the right to the replacement of the defective goods or to withdraw from the purchase contract
- If the defects are removable and are present in large numbers or repeatedly and prevent the proper use of the goods, the right to the replacement of the defective goods or to withdraw from the purchase contract
- In the case of other irremovable defects and if the consumer does not request replacement of the item, the right to a reasonable discount on the purchase price or to withdraw from the purchase contract
